§ 1 General information

§ 3 Conclusion of the contract
Orders will only be accepted by persons capable of acting. In the case of minors or persons under guardianship, the consent of the legal representative is required. The customer accepts these terms and conditions unconditionally with every order.
A contract between the customer and HAAG Brass by Fabian Bächi is deemed concluded when HAAG Brass by Fabian Bächi accepts the order. This is done by sending the ordered item or an order confirmation to the customer. If the article ordered on the homepage is subject to a typing, printing or calculation error, HAAG Brass by Fabian Bächi is entitled to withdraw from the contract at any time. If an article is no longer available, HAAG Brass by Fabian Bächi is entitled to withdraw. In this case, she will contact the buyer to offer a possible replacement.
§ 4 Shipping
The goods will be sent after receipt of payment, depending on availability. If a product has to be manufactured first, the delivery can be sent up to 12 months after receipt of the money. Transport damage must be reported to the responsible forwarding agent or HAAG Brass by Fabian Bächi within 5 days of receipt of the goods. Information on delivery times is non-binding unless the delivery date has been promised as an exception. The dispatch takes place primarily with the Swiss Post. Bulky or particularly heavy goods are delivered by a forwarding agency.HAAG Brass by Fabian Bächi is not obliged, if it has not been expressly agreed, to clarify the type of dispatch with the customer.
All transports are insured by HAAG Brass by Fabian Bächi.
§ 5 minimum order quantity
There is no minimum order quantity
§ 6 Shipping costs
The shipping costs are calculated according to the place of delivery.
§ 7 Right of return
Basically there is no right of return.
§ 8 Liability for delivery
HAAG Brass by Fabian Bächi accepts no liability for undeliverable or delayed delivery of products due to incorrectly declared delivery addresses, absence of the recipient, customs problems or events that can be attributed to force majeure.
§ 9 Prices
The prices indicated are net prices including VAT plus shipping costs. Price changes and errors reserved.
§ 10 Payment Options
HAAG Brass by Fabian Bächi accepts payment by invoice, credit card (Visa®, MasterCard®), PayPal, Postfinance, prepayment or cash on collection.
§ 11 Late payment costs
Processing fee (earliest from day 70 after the invoice date, when handing over to the debt collection service provider) depending on the amount of the claim, maximum amount in CHF: 50 (up to 20) 70 (to 50); 100 (to 100); 120 (up to 150); 149 (up to 250); 195 (to 500); 308 (up to 1,500); 448 (up to 3,000); 1,100 (to 10,000); 1,510 (to 20,000); 2,658 (up to 50,000); 6% of the claim (from 50,000).
§ 12 Warranty
The warranty rights are based on the provisions of the Swiss Code of Obligations, Art. 197 ff OR. Accordingly, the warranty rights expire 2 years after delivery (guarantee period).
§ 13 Right of Ownership
The goods remain the property of HAAG Brass by Fabian Bächi until they have been paid for in full.
§ 14 Data protection
When processing and using personal data of the customer, HAAG Brass by Fabian Bächi assures to observe the data protection law and other relevant legal norms. Personal data will be treated confidentially and will not be passed on to third parties.
§ 15 Applicable Law and Jurisdiction
Swiss law applies to the exclusion of the UN sales law. The place of jurisdiction for all claims in connection with the business relationship is Weinfelden, Thurgau, Switzerland.
